Abstract:

This paper aims to define the legal nature of the arbitration clause and consequently to identify the legal regime applicable to the institution in question. The arbitration agreement is usually attributed with substantive nature, procedural nature or mixed (substantive-procedural) nature; sometimes it is also viewed as a contract sui generis. Based on the research conducted a conclusion can be made that an arbitration clause does not have the properties of a procedural step or the properties of a substantive step; it is also impossible to call it a substantive law contract. Nevertheless, the arbitration agreement may be attributed with a substantive law nature. Consequently, to the extent not regulated directly by the Code of Civil Procedure it should be admissible to apply to the arbitration agreement, by analogy or mutatis mutandis, the provisions of the Civil Code relating to legal transactions or to contracts.
