Abstract:

The book discusses the dilemma of classifying a legal entity as either private or public one and therefore entitled to or prohibited from claiming constitutional rights in Poland. Polish constitutional law has not developed a clear doctrine which would help to categorize legal entities as a bearer of fundamental rights, especially when the state is not the ultimate backer of private-law organized legal person (e.g. mixed capital companies). The book provides critical insight on the jurisprudence of Polish Constitutional Tribunal, foreign courts and tribunals which may help to clarify the constitutional position of legal persons
