Abstract:

The aim of the considerations contained in the monograph is to characterize two institutions: a school and a penitentiary, with particular emphasis on their features that favor calling them total institutions. The idea for writing a book combining the analysis of two different institutions of a prison and a school came from the fact that the 21st century brings general disappointment with the institution of the penitentiary, but also the school. According to the common opinion, these institutions are ineffective. Hence, their fundamental changes are postulated. The juxtaposition of the prison and school shows that total institutions can have a diverse character and can serve different purposes. In fact, totality is not an evil in itself, aslong as it can be regarded as consistent with the principle of proportionality. Therefore, individual restrictions must lead to the achievement of the goals for which a given institution was established. When examining the totality of two selected institutions - a prison and a school - attention was paid to the "clear" sides of the examined institutions (eg the rights of the convict, the rights of the student).  
Celem rozważań zawartych w monografii jest charakterystyka dwóch instytucji: szkoły i zakładu karnego, ze szczególnych uwzględnieniem ich cech przemawiających za nazywaniem ich instytucjami totalnymi. Pomysł na napisanie książki, łączącej analizę dwóch różnych instytucji zakładu karnego i szkoły, wziął się stąd, iż XXI wiek przynosi generalne rozczarowanie instytucją zakładu karnego, ale też i szkoły. Według powszechnej opinii instytucje te są nieefektywne. Stąd postuluje się ich gruntowne zmiany. Zestawienie zakładu karnego i szkoły pokazuje, że instytucje totalne mogą mieć różnorodny charakter i mogą służyć różnym celom. W istocie totalność nie jest złem samym w sobie, o ile tylko można ją uznać za zgodną z zasadą proporcjonalności. Poszczególne ograniczenia muszą więc prowadzić do realizacji celów, dla których powołano daną instytucję. Badając totalność dwóch wybranych instytucji – zakładu karnego i szkoły- zwrócono uwagę na „jasne” strony badanych instytucji (np. prawa skazanego, prawa ucznia).
